Russell & Herrera is committed to the principle of resolving disputes without court intervention whenever possible. This means working with clients to find alternative approaches to reach an agreement outside the courtroom—an outcome that can save the client both time and financial resources.

The firm has placed itself in the forefront of the new Collaborative Practice movement, an arrangement where attorneys and clients agree at case outset not to take the case to court until there is an agreement. Instead, lawyers and clients along with other professionals pledge to work as a team toward designing an amicable as well as an appropriate settlement of the issues involved in the case.

Russell & Herrera, a Martindale-Hubbell AV rated law firm, provides experienced and skilled guidance to clients in the areas of family law, estate and fiduciary law, probate administration and business issues. D. Lynn Russell and Ann J. Herrera have been in practice together since 1984.

Fiduciary Law & Probate Administration

A fiduciary relationship is created when an individual serves as a Power of Attorney Agent, Conservator, Guardian, Executor, Administrator or Trustee. Once a fiduciary relationship is created, the fiduciary owes a fiduciary duty, described as the “highest duty under the law”, to the beneficiary of the fiduciary relationship. Fiduciary relationships are always subject to audit by the beneficiary or other interested parties.
